By accessing or using the website at orcuttinsulation.com (the "Site") or by engaging Orcutt Insulation ("we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or our services.
We may update these Terms from time to time. Continued use of the Site or our services after changes are posted means you accept the revised Terms.
Orcutt Insulation provides residential and commercial insulation services in Orcutt, CA and surrounding communities. Services include but are not limited to spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, air sealing, vapor barrier installation, and insulation removal.
The Site is provided for informational purposes and to allow prospective customers to request estimates. No contract for services is formed by your use of the Site alone.
Any estimate provided by Orcutt Insulation - whether through the Site, by phone, by email, or in person - is based on the information available at the time it is prepared. Final pricing may vary if site conditions, scope, or materials differ from what was assessed during the estimate visit.
A written estimate will be provided before any work begins. No work will start without your approval of the written scope and price. Changes to the agreed scope requested after work has begun may result in additional charges, which will be communicated to you before that additional work proceeds.
Once a job is scheduled, we ask that you notify us at least 48 hours in advance if you need to reschedule. We understand that things come up and we will work with you to find a new time.
If we arrive at a scheduled job and are unable to access the property or begin work due to conditions within the customer's control, a trip fee may apply. We will notify you of any such fee before assessing it.
Payment terms will be outlined in the written estimate or contract for your specific job. Unless otherwise agreed in writing, payment is due upon completion of the work. We accept payment by the methods listed in your written agreement.
Accounts that remain unpaid beyond the agreed payment date may be subject to late fees or referral to a collections process. We will make reasonable efforts to contact you before taking collection action.
We stand behind our work. If a defect in our installation is identified within a reasonable period after completion, contact us and we will address it.
However, our warranty does not cover damage caused by conditions outside our control, including but not limited to water intrusion from sources unrelated to our work, pest damage, structural movement, alterations made by other contractors, or normal wear and tear. The Site and its content are provided "as is" without warranties of any kind, express or implied.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, Orcutt Insulation will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a specific job will not exceed the amount paid by you for that job. Nothing in these Terms limits liability that cannot be limited under applicable law.
All content on the Site - including text, images, logos, and design elements - is owned by or licensed to Orcutt Insulation. You may not reproduce, distribute, or use Site content for commercial purposes without our written permission.
If a dispute arises between you and Orcutt Insulation, we ask that you contact us first and give us a reasonable opportunity to resolve it. Most issues can be resolved by a direct conversation.
If a dispute cannot be resolved informally, you agree that it will be resolved through binding arbitration under the rules of the American Arbitration Association, rather than in court, except for claims that qualify for small claims court. This agreement to arbitrate does not apply to disputes involving our licensed contractor work subject to state contractor licensing board jurisdiction, which may be submitted to the California Contractors State License Board.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration will be brought in a court of competent jurisdiction in California.
We reserve the right to modify these Terms at any time. When we make changes, we will update the effective date at the top of this page. Your continued use of the Site or our services after the updated Terms are posted constitutes your acceptance of the changes.
